Kamsie Terms of Service
Draft — effective on launch Last updated: October 15, 2026
These Terms of Service (the "Terms") are an agreement between you and [Kamsie Legal Entity Name] ("Kamsie", "we", "us") governing your use of the Kamsie mobile application, the website at kamsie.app, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, Community Guidelines, and Child Safety Policy, which are part of these Terms. If you do not agree, do not use the Service.
1. What Kamsie is
Kamsie is a live-only social service. There is no feed, no follower counts, and no uploading of pre-recorded media. The core experiences are:
- Drops — live camera recordings of up to 60 seconds, captured in the app, which expire 60 minutes after they are made.
- Pulse — a live map showing coarse, approximate presence of people who are live nearby.
- Resonance — live rooms that match people by an "energy" profile rather than by distance, where time spent live together is measured by the Service.
- Circle — the people you have mutually connected with through Resonance.
- The Keep — each user may permanently keep one Drop per day. A Keep is final and cannot be undone.
- Kamsie Lock — a joint moment created in person by two users together.
- Messages — direct messages that unlock only after two users have spent at least 30 minutes live together in the Service.
Features may change, pause, or end as Kamsie develops. Where a change materially affects a core promise of the Service — for example, that we do not sell personal data or run advertising — we will say so plainly in the Service before the change takes effect.
2. Eligibility
You must be at least 18 years old to use Kamsie. By using the Service you represent that you are 18 or older, that you are legally able to enter into these Terms, and that you are not barred from using the Service under applicable law or by a prior Kamsie ban. Kamsie is adults-only; accounts found to belong to anyone under 18 will be terminated and their data handled as described in the Privacy Policy and Child Safety Policy.
3. Your account
- Sign-in is by email code. We email you a six-digit code; there is no password. You are responsible for keeping access to your email account secure, because anyone with your code can sign in as you.
- One account per human. Creating additional accounts to evade a ban, a limit, or an enforcement action is prohibited.
- Your handle, display name, initials, and Aura (a generative colour identity) are visible to other users as described in the Privacy Policy. Choose a handle you have the right to use; handles may not impersonate another person or brand.
- You may delete your account at any time in the app (You → Leave Kamsie). Deletion is permanent. Certain records may be retained as described in the Privacy Policy (for example, safety records needed to enforce bans and legal obligations).
- We may reclaim handles that are inactive for an extended period, are infringing, or are needed to resolve impersonation, with notice where practical.
4. Your content and your licence to us
"Your Content" means the Drops, messages, waves, profile details, Aura customisations, and other material you create or send through the Service.
- You own Your Content. Kamsie does not claim ownership of it.
- To operate the Service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, transmit, display, reproduce (including making the technical copies needed for delivery and expiry), and otherwise use Your Content solely as needed to provide the Service to you and to the people you share it with, and to enforce these Terms. This licence ends when the content is deleted or expires, except for copies retained under the Privacy Policy's retention schedule, content another user has Kept or Locked (see Section 5), and content we must retain for legal or safety reasons.
- Drops you make are recorded on your device and stored by the Service until they expire 60 minutes later. Live viewing of a Drop by your Circle is a stream: Kamsie does not record the stream itself. The person making a Drop is responsible for everyone and everything in frame.
- You are responsible for Your Content and for having every right needed to share it — including the consent of anyone recognisably recorded, where the law requires it. Do not record people in situations where they have a reasonable expectation of privacy.
- Because Kamsie is live and ephemeral by design, we generally cannot retrieve content after it expires, and we do not promise to.
5. Keeps and Locks
- The Keep. You may Keep exactly one Drop per day (UTC). Keeping is deliberate and irreversible: there is no un-Keep, and our team cannot reverse one for you. A Kept Drop is retained in your Keeps beyond the 60-minute expiry. If the person who made a Kept Drop deletes their account or the Drop is removed for a policy violation, the Keep may be removed as well.
- Kamsie Lock. A Lock is created jointly, in person, by two users. Either participant may end a Lock; ending it ends it for both. Lock media lives on the participants' devices; Kamsie does not keep a server copy of a Lock's film.
- Global Keep. If your Drop is selected as a Global Keep, it may be shown to users of the Service as the most-Kept Drop of the day, attributed to your handle and Aura. You can avoid this by not posting Drops.
6. Acceptable use
You agree to follow the Community Guidelines, which are part of these Terms, and additionally agree not to:
- break the law, or use the Service to plan or facilitate wrongdoing;
- harass, threaten, stalk, dox, or intimidate anyone, on or off the Service;
- create, share, or solicit sexual content involving anyone under 18, or any non-consensual intimate imagery — see the Child Safety Policy; violations end your account and are reported as the law requires;
- record or stream people without consent where consent is legally required, or in private spaces;
- impersonate any person or misrepresent your affiliation;
- scrape, crawl, data-mine, or bulk-collect the Service or its users, or attempt to reconstruct users' locations, identities, or contact details from hashes, presence data, or any other Service data;
- probe, scan, or test the vulnerability of the Service, circumvent rate limits, security measures, the 30-minute message gate, the one-Keep-per-day limit, or any other product rule enforced by the Service;
- use bots, scripts, emulators, modified clients, or other automation to create accounts, accrue live time, send waves or messages, or otherwise fake presence — live time must be lived;
- sell, rent, or transfer your account, handle, Keeps, or access;
- interfere with the Service's operation, including by overloading infrastructure or transmitting malware.
7. Live media rules
- The camera is the only way in. Drops must be captured live in the app at the moment they are posted. Pre-recorded, edited, filtered, screen-captured, or re-photographed media is not permitted as a Drop.
- Live watching is for your Circle only. Do not restream, re-broadcast, or record another person's live Drop or room outside the Service, and do not help anyone else do so.
- Being live is a representation that you are present. Leaving a device running to accrue live time ("idling") to unlock messages or Resonate is a violation of these Terms.
- Location shown by Pulse is coarse and approximate. Do not use Pulse to track, follow, or locate any person in the physical world, and do not go to a person's location uninvited.
8. Moderation and enforcement
We may review content and accounts using automated systems and human review, including in response to reports and blocks. We may remove content, end Drops or rooms, restrict features, suspend, or permanently terminate accounts that violate these Terms or the Community Guidelines, with or without notice depending on severity. Child-safety violations are zero-tolerance (see the Child Safety Policy). We are not obliged to monitor the Service, and ephemeral content may expire before review is possible. Our enforcement decisions under the Community Guidelines include an appeals path described there.
9. Kamsie Plus (not yet available)
Kamsie Plus is a future paid tier described in the Plus Terms. Plus is not currently available for purchase, and nothing in the app charges you today. When Plus launches, purchases will be processed by the app store, and the Plus Terms will govern in addition to these Terms. The core Service — Drops, Resonance, your Circle, and one Keep a day — is and will remain free. We will never sell extra Keeps, longer Drops, reach or placement on Pulse, faster Resonating, user data, or advertising. That list is a term of this agreement, not a marketing line.
10. Third-party services
The Service relies on third-party processors, including Cloudflare (hosting, storage, and live streaming infrastructure) and Google Firebase (push notifications). Your use of app stores (Google Play, Apple App Store) is governed by their terms. We are not responsible for third-party services we do not control.
11. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or available in any particular place, or that any person you meet through the Service is who they claim to be or safe to meet. Kamsie connects adults in real life; exercise the same caution you would with anyone you do not know. Meet in public, tell someone where you are, and trust your judgement over anything the app shows you.
12. Limitation of liability
To the maximum extent permitted by law: (a) we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from or related to the Service or these Terms; (b) our total liability for any claim arising from or related to the Service or these Terms will not exceed the greater of US$100 or the total amount you paid us in the 12 months before the claim arose; and (c) nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights. Some jurisdictions do not allow certain limitations, so some of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Kamsie and its operators from claims, damages, liabilities, and reasonable legal fees arising from Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right — including any claim that a person you recorded was recorded unlawfully. This section does not apply to the extent a claim arises from our own misconduct.
14. Dispute resolution; arbitration; class waiver
[ATTORNEY REVIEW REQUIRED — this section is drafted for review and must be confirmed by licensed counsel before launch.]
Please read this section carefully. Except where prohibited by law: (a) any dispute arising from or relating to the Service or these Terms will be resolved by binding individual arbitration administered by [arbitration administrator] under its consumer rules, seated in [Nevada], rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for intellectual-property or safety matters; (b) you and Kamsie waive any right to a jury trial and to participate in a class action, collective action, or representative proceeding; (c) you may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@kamsie.app with your handle and a clear statement that you opt out; (d) if the class waiver is found unenforceable as to a claim, that claim proceeds in court and not in arbitration. Nothing in this section prevents you from reporting concerns to a government agency.
15. Governing law
These Terms are governed by the laws of the State of [Nevada], without regard to conflict-of-laws rules, except where the mandatory consumer-protection law of your place of residence provides otherwise.
16. Changes to these Terms
We may update these Terms. If a change is material, we will give reasonable notice in the Service or by email before it takes effect, and the updated Terms will state their effective date. Continuing to use the Service after a change takes effect means you accept it. If you do not accept a material change, stop using the Service and delete your account before the effective date.
17. General
These Terms are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect, and the provision will be read as narrowly as needed to make it enforceable. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the Service, with notice. Headings are for convenience only.
